Madonna loses a legal battle against Darlene Lutz
Madonna has lost the battle after trying to stop Tupac’s letter and personal items from being auctioned. Madonna lost an almost year-long attempt to stop an auction of Shakur intimate items. The items include a letter from Tupac Shakur, the rap legend.
Madonna loses a legal battle – Judgement
A judge ruled that she went on this battle for the wrong reasons. She went after a New York art dealer, Darlene Lutz who did help her build a collection and later had a fall out with her.Ms. Lutz is the main source for the 22 items which includes a hairbrush, love letters and cassettes that were put up for sale by the auction house Gotta Have Rock and Roll until an injunction issued by the judge in July. Judge Gerald Lebovits, from New York, based his ruling on fine legal grounds, rather than on Madonna’s claims of defilements of privacy, which she has an agreement with Ms. Lutz. Ms. Lutz had said that her arguments with Madonna were settled by a 2004 legal contract between the former friends.
Judge Lebovits questioned why she was fighting Ms. Lutz and not Tupac’s assistants, who she said had handed items to Ms. Lutz, an art dealer. If the accuser’s allegations are accepted as true that Ms. Lutz did receive the letters through unintentional actions of the plaintiff’s assistants, then her case against Ms. Lutz was improper.
Madonna loses a legal battle – The Auction House
The auction house said it would go ahead with the sale of the merchandise in July. The sale will also include the offending letter from Tupac. In a statement, Gotta Have Rock and Roll said that they were very confident with the case and all went well. This was before they announced the auction to take place in July. Ms. Lutz’s lawyer called the court decision a total win. She is now free to do what she wants with her property and be bothered by Madonna.
Items Up For Auction
The items that are up for auction consists of part of a collection of 100 pieces that were included in the 1995 letter that was from Tupac. Tupac got shot dead a year later. Madonna spoke publicly about their secret relationship recently.
